What does federal law say about THCa in 2026?
Today, the 2018 Farm Bill still defines hemp as cannabis with no more than 0.3% delta-9 THC by dry weight, and THCa was not counted toward that figure. A law signed on November 12, 2025 (Public Law 119-37) changes the definition: hemp will be measured by total THC, which includes THCa, and finished hemp-derived products will be capped at 0.4 mg total THC per container. A second law signed on September 2, 2026 (Public Law 119-103) moved most of that to December 11, 2026, while the exclusion of cannabinoids the plant cannot make naturally still starts November 12, 2026. Congress could change these dates again, so check before you order.
Can a state set its own rules on hemp-derived THC?
Yes. States can add rules of their own, such as potency limits, total-THC testing, licensing, age checks or limits on where products are sold, and those rules change often. Check your state and local law before you order, because they can differ from the federal baseline.
